In the contemporary times, we observe that the called post-modern culture enabled the youth culture to do the own constructions and choices, including religion. This research tried to understand how occurred the cultural and religious construction of youth urban tribes, here represented for headbangers from Caverna de Adulão Community. In this community, the rock was used as an instrument of socialization among the youth. The hypothesis of this research consists in observing that the religious practicing can be affected for cultural (...) changes. While some religious institutions resist changes, others take advantage of it. We could observe that the adaptations of some evangelical churches to the necessities of youth and their cultural practicing can be what attract them to Caverna de Adulão Community, where the rock was allied to religious practicing. At the first part of the paper we described the strategies used to promote the community of youth that are in most varied urban tribes, participants of Caverna de Adulão Community. We tried to identify the motivation of youth that seek to become part of evangelical groups. In the second part we presented how the music and the service, contextualized to youth, as the case of rock, can be attractive to the urban tribes and how this phenomenon open a dialog between religion and the youth culture. At the end we analyzed how occurs the socialization among evangelical youth from urban tribes with rock, both culturally and religiously, in order to understand how the construction of the religious phenomenon happens in Caverna de Adulão Community. The methodology used was established through the bibliographic research and field research with socio-anthropological-ethnographic studying, through participant observation and discussions in focal group. We verified, at the end of the paper, that our hypothesis was partially proved when we observe that rock exerted, in the studied community, the socializing role among the members. However, today rock has moved away from the center of sociability and other elements come into its place, which has given the community greater cultural diversity. (shrink)

A Associação Brasileira de Famílias Homotransafetivas (Abrafh) é uma entidade que luta pelo reconhecimento das populações cujo núcleo é formado por sujeitos LGBTQIA+. A instituição busca representar os anseios e expectativas dessas famílias em diferentes âmbitos sociais, assim como combater os desrespeitos e preconceitos advindos de um sistema heterossexista. Este trabalho busca compreender como a Abrafh mobiliza as dimensões do afeto e da solidariedade na luta política. Para isso, entrevistamos quatro representantes do primeiro conselho diretor. Por meio de uma análise (...) qualitativa de conteúdo discursivo, pudemos compreender que a Abrafh, segundo os diretores, surge para acolher, defender e representar as famílias homoafetivas no sentido de tornar estes cidadãos emancipados e com direitos reconhecidos. Conclui-se que a instituição atua principalmente a partir da possibilidade de responder satisfatoriamente à necessidade que os sujeitos têm de desenvolverem conexões baseadas na confiança afetiva na continuidade da dedicação mútua. BackgroundInnovations in technology have contributed to rapid changes in the way that modern biomedical research is carried out. Researchers are increasingly required to endorse adaptive and flexible approaches to accommodate these innovations and comply with ethical, legal and regulatory requirements. This paper explores how Dynamic Consent may provide solutions to address challenges encountered when researchers invite individuals to participate in research and follow them up over time in a continuously changing environment.MethodsAn interdisciplinary workshop jointly organised by the University of Oxford (...) and the COST Action CHIP ME gathered clinicians, researchers, ethicists, lawyers, research participants and patient representatives to discuss experiences of using Dynamic Consent, and how such use may facilitate the conduct of specific research tasks. The data collected during the workshop were analysed using a content analysis approach.ResultsDynamic Consent can provide practical, sustainable and future-proof solutions to challenges related to participant recruitment, the attainment of informed consent, participant retention and consent management, and may bring economic efficiencies.ConclusionsDynamic Consent offers opportunities for ongoing communication between researchers and research participants that can positively impact research. Dynamic Consent supports inter-sector, cross-border approaches and large scale data-sharing. Whilst it is relatively easy to set up and maintain, its implementation will require that researchers re-consider their relationship with research participants and adopt new procedures. (shrink)

Objective: While behavioral recommendations regarding physical activity commonly focus on reaching demanding goals by proposing ‘thresholds’, little attention has been paid to the question of how much of a behavioral change is needed to make people feel that they have changed. The present research investigated this relation between actual and felt behavior change. Design: Using data from two longitudinal community samples, Study 1 and 2 comprised 614 (63 % women) and 398 participants (61 % women) with a mean age of (...) 40.9 years (SD = 13.6) and 42.5 years (SD = 13.4), respectively. Using a stage-approach, participants were classified into four groups by asking them at the respective second measurement to indicate whether they had become more physically active since their last participation six months ago (“Changers”), had tried but did not succeed in becoming more physically active (“Attempters”), were already physically active on a regular basis (“Regular Actives”), or had not tried to become more physically active (“Non-Attempters”). Physical activity was measured using the International Physical Activity Questionnaire (IPAQ), and fitness level was assessed as physical working capacity (PWC) via bicycle ergometry. Mixed ANOVAs including Time and Perceived Change as within and between factors were conducted, followed up by simple effect analyses. Results: Participants stating to have become more active in the past six months (Changers) showed a significant increase in vigorous physical activity but not in moderate physical activity, with an average of 6.8 (Study 1) and 10.6 (Study 2) MET-h per week in vigorous activity. Corroborating these findings, objective fitness also significantly increased in the group of Changers. No systematic change in moderate or vigorous physical activity was observed for the three other ‘non-changer’ groups (regular actives, attempters, non-attempters). Conclusion: The intensity of physical activity is the crucial variable for people’s perception of change in physical activity. Moderate physical activity seems not to be perceived as an effective means for behavior change. It thus might fail to unfold sufficient motivational impact, despite its known positive effects on health. (shrink)

Special Relativity can be based on the whole proper group of both ortho- and antichronous Lorentz transformations, and a clear physical meaning can be given also to antichronous (i.e., nonorthochronous) Lorentz transformations. From the active point of view, the latter requires existence, for any particle, of its antiparticle within a purely relativistic, classical context. From the passive point of view, they give rise to frames “dual” to the ordinary ones, whose properties—here briefly discussed—are linked with the fact that in relativity (...) it is impossible to teach another, far observer (by transmitting only instructions, and no physical objects) our own conventions about the choices right/left, matter/antimatter, and positive/negative time direction. Este artigo analisa alguns aspectos da moral cartesiana. Num primeiro momento, investiga-se como a expressão moral provisória é equivocada e como a moral do Discurso é retomada na Correspondência. Num segundo momento, é interessante a compreensão da nova significação que Descartes fornece ao termo paixões. Enfim, mostra-se como a moral se insere, paulatinamente, na filosofia de Descartes.

A discussão parte da indicação de Scheler, presente no seu escrito Liebe und Erkentnnis: énecessário superar a concepção intelectualista do amor, para compreender genuinamente ainterdependência entre amor e conhecimento. Nesta perspectiva, procura-se mostrar que oamor não apenas antecipa o conhecimento como motor e via, mas também o consuma,inserindo-o em esferas ontológicas primordiais, ao ascender a intelecção das essências a graumais evidente e a um modo mais originário. No primeiro momento, parte-se do conhecimento,destacando o ato de ideação como o específico do (...) espírito humano, para chegar ao modoclarividente do amor conhecer por participação no ser. Em segundo momento, em linhasgerais, evidencia-se o amor como ato fundamental da estrutura intencional e princípiogenerativo da ordem de fins da existência humana. This paper provides a systematic literature review, analysis and discussion of methods that are proposed to practise ethics in research and innovation. Ethical considerations concerning the impacts of R&I are increasingly important, due to the quickening pace of technological innovation and the ubiquitous use of the outcomes of R&I processes in society. For this reason, several methods for practising ethics have been developed in different fields of R&I. The paper first of all presents a systematic search of academic sources that (...) present and discuss such methods. Secondly, it provides a categorisation of these methods according to three main kinds: ex ante methods, dealing with emerging technologies, intra methods, dealing with technology design, and ex post methods, dealing with ethical analysis of existing technologies. Thirdly, it discusses the methods by considering problems in the way they deal with the uncertainty of technological change, ethical technology design, the identification, analysis and resolving of ethical impacts of technologies and stakeholder participation. The results and discussion of our literature review are valuable for gaining an overview of the state of the art and serve as an outline of a future research agenda of methods for practising ethics in R&I. In this study, we aim to disentangle pantomime from early signs in a newly-born sign language: Sao Tome and Principe Sign Language. Our results show that within 2 years of their first contact with one another, a community of 100 participants interacting everyday was able to build a shared language. The growth of linguistic systematicity, which included a decrease in use of pantomime, reduction of the amplitude of signs and an increase in articulation economy, showcases a learning, and social interaction (...) process that constitutes a continuum and not a cut-off system. The human cognitive system is endowed with mechanisms for symbolization that allow the process of arbitrariness to unfold and the expansion of linguistic complexity. Our study helps to clarify the role of pantomime in a new sign language and how this role might be linked with language itself, showing implications for language evolution research. (shrink)

Responding to serious environmental problems, requires urgent and fundamental shifts in our day-to-day lifestyles. This paper employs a qualitative, cross-cultural approach to explore people’s subjective self-reflections on their experiences of pro-environmental behavioral spillover in three countries; Brazil, China, and Denmark. Behavioral spillover is an appealing yet elusive phenomenon, but offers a potential way of encouraging wider, voluntary lifestyle shifts beyond the scope of single behavior change interventions. Behavioral spillover theory proposes that engaging in one pro-environmental action can catalyze the performance (...) of others. To date, evidence for the phenomenon has been mixed, and the causal processes governing relationships between behaviors appear complex, inconsistent and only partly understood. This paper addresses a gap in the literature by investigating accounts of behavioral spillover in three diverse cultural settings using qualitative semi-structured interviews. The analysis shows that while around half of participants overall who were questioned recalled spillover effects, the other half had not consciously experienced spillover. There were few significant differences across cultures, though some forms of spillover effects were reported more in some cultures than others. More environmentally-engaged participants across all three countries were significantly more likely to experience spillover than those who were less engaged. Accounts of within-domain spillovers were most commonly reported, mainly comprising waste, resource conservation and consumption-related actions. Accounts of between-domain spillover were very rare. Recollection of contextual and interpersonal spillover effects also emerged from the interviews. Our findings suggest that more conscious behavioral spillover pathways may be limited to those with pre-existing environmental values. Behavioral spillover may comprise multiple pathways incorporating conscious and unconscious processes. We conclude that targeting behavioral catalysts that generate more socially diffuse spillover effects could offer more potential than conventional spillover involving a single individual. (shrink)

Estimating the effects of introducing a range of smart mobility solutions within an urban area is a crucial concern in urban planning. The lack of a simulator for the assessment of mobility initiatives forces local public authorities and mobility service providers to base their decisions on guidelines derived from common heuristics and best practices. These approaches can help planners in shaping mobility solutions; however, given the high number of variables to consider, the effects are not guaranteed. Therefore, a solution conceived (...) respecting the available guidelines can result in a failure in a different context. In particular, difficult aspects to consider are the interactions between different mobility services available in a given urban area and the acceptance of a given mobility initiative by the inhabitants of the area. In order to fill this gap, we introduce Tangramob, an agent-based simulation framework capable of assessing the impacts of a smart mobility initiative within an urban area of interest. Tangramob simulates how urban traffic is expected to evolve as citizens start experiencing newly offered traveling solutions. This allows decision makers to evaluate the efficacy of their initiatives, taking into account the current urban system. In this paper, we provide an overview of the simulation framework along with its design. To show the potential of Tangramob, three mobility initiatives are simulated and compared in the same scenario. This demonstrates how it is possible to perform comparative experiments so as to align mobility initiatives to the user goals. (shrink)

The term Ubuntu is often presented as a mere ontological, philosophical African worldview. However, the aim of this article is to equate Ubuntu philosophy with a category of open legal principles of a constitutional nature, which, although they are not formally enshrined in the written constitutions of southern African countries that share the Bantu culture, have a normative deontic character. Therefore, it is worth emphasising that this category of thought is socially present as a norm of practical reason, from which (...) emanates the concept of justice of the Bantu peoples, who preserve a communitarian cultural identity rather than individualistic Western liberalism. The purpose of this study is to associate this worldview with a constitutional foundation of African states, especially those in southern Africa, equating it with the principles of human dignity, equality and freedom, etc., which is important for the consolidation of human rights in Africa. On the other hand, this worldview is confronted by the post-modern paradigms of global liberalism, which is also currently amalgamated in African countries. In order to achieve this objective, the research will be conducted using a methodology based on a bibliographical review and a deductive approach, supported by elements of constitutional legal dogma. Há uma filosofia da diferença que precisa ser mais considerada nos nossos tempos, visto que se opõe à tradição filosófica identitária dos pré-socráticos à atualidade, que se apegou obstinadamente à ideia de identidade, que vislumbra o real, somente através da referência ao idêntico. Nessa perspectiva, os anseios e peculiaridades dos mais diversos movimentos sociais precisam ser ouvidos de modo mais efetivo pela filosofia e pela ciência. Mesmo nas ciências exatas, a teoria não é eterna, quanto mais nas sociais aplicadas, como (...) é na ciência da informação, e consequentemente, na organização do conhecimento. Posto isto, este trabalho tem como objetivo inter-relacionar alguns aspectos históricos da epistemologia geral com as epistemologias feministas, destacando-se a corrente pós-estruturalista. E assim, compreendermos alguns dos seus desdobramentos na organização do conhecimento, a fim de percebermos se ela está disposta a incorporar novas práticas, a partir de reinvindicações de movimentos, como o feminista. Constatamos que além de toda historicidade das relações de poder que tem raízes profundas e muito antigas, há nos dias hodiernos um grupo despreocupado em ratificar novas práticas mais humanizadas e coerentes às várias esferas, dentre as quais está a organização do conhecimento, por questões não só políticas, mas econômicas. A função social da biblioteca pública está estreitamente vinculada a um determinado espaço geográfico para desenvolver ações que integrem demandas de informação, educação e cultura na comunidade. Essa noção fundamental outorga o rol de atributos operacionais das competências políticas legitimadas em processos históricos para essas instituições. Com o objetivo de analisar o contexto teórico qualificado ao sentido de comunidade é que o presente artigo estabeleceu uma reflexão sobre o papel social da biblioteca pública na contemporaneidade. Metodologicamente foi realizada uma pesquisa (...) bibliográfica que se orientou pela revisão de literatura guiada pelos questionamentos apresentados por Rabello (1987), Sperry (1993), Pinheiro (2009) e Milanesi (2013). Como resultado, verificou-se que atualmente as bibliotecas públicas estão perdendo espaços norepertório de interesses de sua comunidade. Failla (2021) constatou essa tendência em duas pesquisas realizadas sucessivamente no Brasil, nos anos de 2015 e 2020. Com isso, o presente estudo recomendou mudanças consistentes de aproximação efetiva da biblioteca pública com a comunidade pela articulação sistemática e propositiva da sua estrutura institucional, envolvendo adequação de conceitos e estudos de comunidade para alinhamento com as necessidades informacionais dos novos tempos. The past decade has seen an explosion of work on calculi of explicit substitutions. Numerous works have illustrated the usefulness of these calculi for practical notions like the implementation of typed functional programming languages and higher order proof assistants. It has also been shown that eta-reduction is useful for adapting substitution calculi for practical problems like higher order unification. This paper concentrates on rewrite rules for eta-reduction in three different styles of explicit substitution calculi: λσ, λse and the suspension calculus. (...) Both λσ and λse when extended with eta-reduction rules, have proved useful for solving higher order unification. We enlarge the suspension calculus with an adequate eta-reduction rule which we show to preserve termination and confluence of the associated substitution calculus and to correspond to the eta rules of the other two calculi. We prove that λσ and λse as well as λσ and the suspension calculus are non-comparable while λse is more adequate than the suspension calculus in simulating one-step beta-reduction. After defining the eta-reduction rule in the suspension calculus, and after comparing these three calculi of explicit substitutions , we then concentrate on the implementation of the rewrite rules of eta-reduction in these calculi. We note that it is usual practice when implementing the eta rule for substitution calculi, to mix isolated applications of eta-reduction with the application of other rules of the corresponding substitution calculi. The main disadvantage of this practice is that the eta rewrite rules so obtained are unclean because they have an operational semantics different from that of the eta-reduction of the λ-calculus. For the three calculi in question enlarged with adequate eta rules we show how to implement these eta rules. For the λse we build a clean implementation of the eta rule and we prove that it is not possible to follow the same approach for the λσ and λsusp. (shrink)

No presente artigo, interessa-nos apontar algumas possibilidades acerca da presença, no século X, da obra Formula Vitae Honestae, escrita por Martinho de Braga, que viveu na Galiza no século VI, na biblioteca de San Millán de la Cogolla, mosteiro localizado em La Rioja. De acordo com nossas conclusões, ainda parciais, vinculamos tal presença à identificação dos dois momentos históricos, o da Galiza no século VI e por La Rioja no X, marcados pela reorganização eclesiástica e monárquica.

O processo de conversão ao Cristianismo, em sua versão ortodoxa, dos povos bárbaros assentados em território do Antigo Império Romano, durante os séculos V e VIl, evidencia o empenho das autoridades religiosas capazes de forjar variadas estratégias na busca do seu intento. Nesse sentido, destaca-se a atuação de Martinho de Braga pelo seu sistemático trabalho de evangelização, do que fez parte a redação de variadas obras. Entre estas desejamos sublinhar De Formula Vitae Honestae, obra de caráter político e moral dirigida (...) aos príncipes do referido reino, reproduzida inúmeras vezes na Idade Média a partir do século XII e inserida no conjunto de escritos conhecidos como espelho dos príncipes. Is ruling out the possibility that one is dreaming a requirement for a knowledge claim? In “Philosophical Scepticism and Everyday Life” (1984), Barry Stroud defends that it is. In “Others Minds” (1970), John Austin says it is not. In his defense, Stroud appeals to a conception of objectivity deeply rooted in us and with which our concept of knowledge is intertwined. Austin appeals to a detailed account of our scientific and everyday practices of knowledge attribution. Stroud responds that what Austin (...) says about those practices is correct in relation to the appropriateness of making knowledge claims, but that the skeptic is interested in the truth of those claims. In this paper, we argue that Stroud’s defense of the alleged requirement smuggles in a commitment to a kind of internalism, which asserts that the perceptual justification available to us can be characterized independently of the circumstances in which we find ourselves. In our reading of Austin, especially of Sense & Sensibilia, he rejects that kind of internalism by an implicit commitment to what is called today a “disjunctive” view of perception. Austin says that objectivity is an aspect of knowledge, and his disjunctivism is part of an explanation of why the alleged requirement is not necessary for a knowledge claim. Since both Stroud and Austin are committed to the objectivity of knowledge, Stroud may ask which view of perceptual knowledge is correct, whether the internalist or the disjunctive. We argue that by paying closer attention to what Austin says about our practices of knowledge attribution, one can see more clearly that it is grounded not only on a conception of objectivity, but also on a conception of ourselves as information agents, a conception that is as deeply rooted as that of the objectivity of knowledge. This gives us moral and practical reasons to favor the disjunctive view of perception. (shrink)

Este artigo aborda as memórias do handebol nos jogos escolares maranhenses (JEMs) (1970), em São Luís-MA. O corpus empírico do estudo foi o ginásio desportivo Ronald da Silva de Carvalho, da Escola Técnica Federal do Maranhão (ETFMA). A pesquisa qualitativa com aporte teórico-metodológico da Memória e da História Oral, com entrevista dos “lugares de memória” negras do campo esportivo, objetivou reconstruir as experiências do handebol no JEMs. Os Jogos Escolares Brasileiros e a invasão dos paulistas em São Luis-MA, transformou as (...) configurações na obtenção do sucesso esportivo no campo esportivo brasileiro e internacional. Looking to understand religiosity as a social factor, contributory of constructions of meaning and omnipresent in diverse historical and cultural universes, this article focuses on the ritualistic dimension of religiosity. Adopting as a research problem the religious pilgrimages, take particular note of the shrines as symbolic markers towards the supernatural. This work has a double aim: to carry out a review and critical analysis of the religious pilgrimages and to study the specificity of the pilgrimages to the Shrine of Fatima, (...) located in Portugal. After a brief mention of the dialectic dissidence-coexistence of ancient religious practices in secularized societies, the concepts of worship, rites and sacrifices are revisited. There follows a more in-depth analysis of the theme of pilgrimages to shrines, from the concept and historical review to the particularity of pilgrimages to the Shrine of Fatima, the latter viewed as a geo-symbol of religious tourism in Portugal. The results of a survey of 784 pilgrims to the Shrine of Fátima are presented, focusing on the beliefs, experiences, perceptions, purposes and expectations regarding the pilgrimage, as well as the nature of the requests addressed to the Lady of Fatima and promises fulfilled. Throughout the article the pilgrim character is emphasized, not neglecting the analysis of the active, voluntary and sacrificial behavioral implication as legitimating the benefits already granted or to be granted. Our goal in this paper is to discuss the notion of animal knowledge in Judgment and Agency. Our approach has two stages. First, we offer a positive contribution, attempting to show that there is room for the introduction of emotions into an animal knowledge approach and into Sosa’s theory of competence. If we follow Sosa and conceive knowledge as a kind of action or successful performance, then emotions can contribute functionally for enhancing performance and are essential for the sharing of (...) knowledge among social agents. Second, we offer criticism of Sosa’s integrative project. It’s not clear that reflective knowledge always improves animal knowledge; rather, in order to avoid regress, Sosa should recognize that we can have perfectly safe animal knowledge. Finally, we argue that reflective knowledge has a more marginal role than Sosa seems at first sight to suggest. (shrink)

Este artigo investiga as mudanças conceituais revolucionárias que ocorreram quando a teoria do flogisto de Stahl foi substituída pela teoria do oxigênio de Lavoisier. Utilizando técnicas extraídas da inteligência artificial, o artigo descreve os estágios cruciais no desenvolvimento conceitual de Lavoisier, de 1772 até 1789. Em seguida, é esboçada uma teoria computacional da mudança conceitual de modo a explicar a descoberta de Lavoisier da teoria do oxigênio e a substituiçáo da teoria do flogisto. The term sustainability has become one of the most significant in the current era. It seems to be ubiquitous amongst academics, politicians, business leaders, media personnel and even the general public. It is no exaggeration to state that it is considered all over the world to be the most pressing issue to be addressed for the long-term future of the planet and its inhabitants. The topic is of course complex, and the issue of sustainability is under much debate as to (...) what it actually is and how it can be achieved, but it is completely certain that the resources of the planet are fixed in quantity and, once used, cannot be reused except through being reused in one form or another. At present, much of the discourse of sustainability has focused upon the environment and in particular upon climate change and the effects that this is having. Thus, the discourse has tended to be about mitigation. Sustainability of course requires all three pillars of the triple bottom line—economic, environmental and social—to be addressed. Indeed, it might be considered that the effects upon the social, and how we choose to live our lives, might well be the most profound effect of achieving sustainability. This book therefore focuses upon some of the many aspects of the social and how we can adapt our lives to accommodate the requirements of sustainability. it therefore takes a very different approach to addressing the issues of sustainability, while of course not ignoring the other pillars. This book therefore sets out to examine various aspects of the changes to personal, corporate and institutional behaviour which may have to come about in our search for sustainability. It is tended to address some of the issues and how they are being dealt with in various parts of the world. As always, our concept is to share best practice and thereby enrich both the discourse and our progress towards sustainability. Thus, we focus upon the current situation while also considering the extent to which the focus is changing so much that we need to think about new approaches to our understanding of behaviour and differing effects in practice. The international origins of the contributors to this book make this an original contribution taking some of the best ideas from around the world. This book therefore addresses these issues from a perspective not generally addressed by researchers, or even by politicians and the press. It therefore provides fresh perspectives upon the important issue of our common future. As always, this approach is based on the tradition of the Social Responsibility Research Network srrnet.org (a worldwide body of scholars with membership of several thousand), which in its 20-year history has sought to broaden the discourse and to treat all research as inter-related and relevant to business. This tradition has always been to explore the subject widely and to seek relevant solutions, while also sharing best practice. This book is based primarily upon some of the contributions from the network at our recent conference and shows both commonality and diversity in approaches and effects. (shrink)

This study explored the evidence of validity of internal structure of the 12-item Functional Assessment of Chronic Illness Therapy—Spiritual Wellbeing Scale in Brazilian adolescents with chronic health conditions. The study involved 301 Brazilian adolescents with cancer, type 1 diabetes mellitus, or cystic fibrosis. Exploratory Factor Analysis, Confirmatory Factor Analysis, and Item Response Theory were used to test the internal structure. Reliability was determined with Cronbach’s Alpha and McDonald’s Omega. The EFA suggested a one-dimensional scale structure in contrast to the original (...) 2-factor model or the 3-factor model which were not reproduced in the current CFA. All quality indicators for the EFA one-factor exceeded the required criteria. The FACIT-Sp-12 for adolescents yielded strong evidence for a 1-factor model and with good reliability. (shrink)

O presente artigo detém o intuito de analisar a implementação do sistema de precedentes judiciais adotado pelo Brasil no Novo Código de Processo Civil, diante da teoria de Ronald Dworkin. O Brasil historicamente adota o sistema denominado de Civil Law, o qual adota a lei como fonte principal do Direito, dando ao precedente judicial um caráter secundário e não vinculante. Ante a nova atualização legislativa do Código de Processo Civil de 2015, que vislumbra a adoção de um sistema de precedentes, (...) o Brasil deve superar diversas dificuldades para adequar este sistema ao ordenamento jurídico, pois a maior dificuldade provém do fato da ausência de costume ao observar os precedentes como fonte do Direito. O texto faz uma análise sobre os sistemas judiciais de Civil Law e Common Law trazendo a diferença entre os sistemas e as fontes do Direito que cada um adere, bem como disserta sobre as teorias relativas à Interpretação e Integridade de Ronald Dworkin. Por fim, investiga as alterações legislativas no Código de Processo Civil, bem como a fundamental importância das teorias de Dworkin para implementar no Brasil de maneira correta o sistema de precedentes judiciais. A metodologia utilizada foi o método indutivo de abordagem e o método de procedimento foi o método monográfico. As fontes de pesquisa utilizadas foram as mais diversificadas, tais como livros, artigos, pesquisas em sites, consulta de outras monografias, consulta de tese de mestrado e jurisprudências. (shrink)
